SUBJECT: Michael Hasty – A positive effort to save our game fowl industry

As some of you are aware and some are not, Michael Hastey, a fellow cocker who lives in Lorenzo, TX near Lubbock, TX has filed constitutional challenges to the animal rights laws of Texas, and the animal welfare laws of the U.S. (Farm Bill-Transportation Law in particular). Should he, or better yet, when he receives a favorable ruling, this will do to animal rights groups the same thing as the lawsuit that took prayer out of schools, ended the death penalty in this country for about 12 years, gave women right to abortion; Michael’s suits will end the abilities to have laws of any type giving animals ANY entitlements to rights. Remember in all these instances, it was one lawsuit that changed everything.

Michael is not a lawyer, but he has litigated multiple lawsuits and appeals in Federal Court in the past. He is receiving no direct payment for his work and effort from anyone, nor will he accept any. His motive is strictly for the love of the sport and the only possible benefit he will receive for the hundreds of hours of study and work is the saving of the game fowl industry as we have known it in the past.

In Michael’s own words and I quote, "I want to give the game fowl people my word as a man, a fellow cocker, and as a proud member of TGBA that I am going to win this lawsuit. This suit is only possible because of the insight of the leadership of TGBA and their willingness to take a chance to help finance this, which I could not do alone, as well as the moral support that the Officers and Directors have given me."

The following is a brief summary of the claims of Michael’s lawsuit. Hopefully, this will give everyone a better insight as to the lawsuits that he filed.

Laws giving animals any entitlement to rights is against the laws of nature, the

Bible, common sense, and U.S. Constitution.

Laws giving animals rights deprives animal owners of their property without

the due process of law, by arbitrarily assuming an interest of control over the

animal.

Animals are property, and not entitled to rights, immunities or protections.

Laws giving animals rights violate owner’s privacy rights to decide what to

do or not do regarding their property.

Animal rights laws favor Hindu religious beliefs and contradict the teachings

of the Bible. This injures Christians in the ability to believe the Bible is the truth.

This also injures the Christian faith as a whole.

Animal rights laws deprive owners of liberty protections, dictating to owners

what decisions can be made.

Animal rights laws interfere with the freedom to make and keep contracts.

Animal rights laws illegally interfere with free trade by placing arbitrary

restraints on owners, causing increased cost to producers, and processors,

causing escalated prices to consumers, in an attempt to force us to stop eating

meats, dairy, and eggs, and use of animal skins.

Animal rights laws illegally bring animals into society as a member.

10. States’ police powers given by the Constitution do not allow it to be used for

non-members of society-i.e. animals.

It is a clear and ever-present violation of the Constitution to prohibit the citizen

of one state enjoying the rights and privileges of the citizens of another state when

he travels into that state (the only exception is not being allowed to participate in the other state’s government).

Michael currently has two separate cases filed in the courts. The first case was argued and heard by the District Court in Lubbock, Texas with the judge dismissing the case. Michael then filed notice of appeal. This appeal is currently pending and scheduled to be heard by the Fifth Circuit Federal Court of Appeals in New Orleans, Louisiana. We do not presently know the exact date and which arguments will be made, but Michael has requested to be allowed to give oral arguments, and should be notified when this request is decided. Michael has indicated to the TGBA that all indications appear to be favorable to us, but that is not to say that anything can be taken for granted. This case in the Fifth Circuit involves the direct attack upon the Texas Animal Rights Laws and when we prevail, its effects will extend to all other states.

After the Federal District judge’s decision in the case, for which the appeal was filed, Michael decided it more expedient to refile a separate cause of action with regard to the federal interstate transportation laws. The litigation is proceeding, and the judge has set the case on the docket of the court. This attack basically contains the same factual and legal issues as the initial case filed of property, liberty, belief, privacy, and equal protection. However, there are some additional arguments to this case that are in addition to the state case, one being that the federal government has exceeded constitutional directives which restrict and forbid the federal government from becoming involved and certain activities which are specifically reserved to the states and also to the individuals as citizens.

We, in TGBA, hope the above will give everyone a better understanding of Michael Hastey’s efforts to set Animal Rights Laws aside permanently and we in TGBA, support his effort 100%. We also know you in Oklahoma are fighting for survival and we commend you for all your hard work and you will have our continued support. But with all this said, we do need all the monetary help we can acquire to keep Mr. Hastey’s efforts moving forward.

and that most of these hollywood **** folks are into Hindu Mistycism, they dont even eat beef!
